Every person and situation is different. So, we take a personal approach, whether you want our will writing service, power of attorney, or both.

Experienced legal professionals are on hand to draft and witness your documents. They can also certify your mental capacity when setting up a power of attorney.

You’ll need to appoint at least one executor in your will. This person will manage your estate after your death. We provide professional executor services through Lloyds who are part of the same family as Bank of Scotland.

If you already have a will, but would like to make some changes

You may be able to use a codicil to make a minor change to your will.

A codicil is a separate legal document that changes the terms of your existing will. We’ll need you to send us a copy of the original will by post. Please include any existing codicils.

We can't offer this service online.

Just remember, if you request a codicil, the wording and terms of your original will stay. They won't get removed. After your death, relevant parties can still view the full terms and wording of your original will. Often, it’s better to write a new will.

Setting up a power of attorney   

A power of attorney (POA) is a legal document. It lets you choose one or more trusted individuals to make decisions for you.

You might need this if you can't make decisions yourself. This situation could arise if you lose mental capacity or if you're unwell or injured.

  • A welfare power of attorney is important if you lose capacity. This legal document gives power to someone you trust.

    The person can make decisions for you and handle health and personal welfare matters on your behalf.

All our power of attorney (POA) options include:

  • guidance and advice from a legal professional
  • certification of mental capacity
  • professional witnessing of the power of attorney document or documents
  • registration of power of attorney with the Office of the Public Guardian (Scotland) on your behalf
  • free secure storage of the documentation.

A power of attorney is only valid once it has been registered with the Office of the Public Guardian (OPG) in Scotland.

A fee for each power of attorney is payable to the OPG. We don't include this fee in our pricing.

  • meet one of our legal professionals’ face to face. Brodies have offices in Glasgow, Edinburgh, Aberdeen and Inverness.

Complete your instruction form

You’ll be able to choose to write a will and, or a power of attorney as part of the process. Save your progress and send the instruction form and payment when you’re ready.

Step three.

Book your appointment

Use the online calendar to book your appointment with one of our legal professionals. They’ll talk you through everything on a video call.

Step four.

Drafting your requirements

A legal professional will review and draft your document. Once you’re happy with it, they’ll send you the legal documents to review.

Step five.

Sign your documents on a video call

They’ll organise a video appointment for you to sign your legal documents. During this call, we'll witness your signature. If you prefer, you can send the signed documents back to us. We'll make sure to keep the original safe for you.

Good to know

A power of attorney is only valid once it’s been registered with the Office of the Public Guardian (Scotland).

We can do this for you, or you can do this yourself.

A fee for each power of attorney is payable to the Office of the Public Guardian (Scotland). We don't include this fee in our pricing.
